Article 170
A person who is not a member of the Provincial Assembly can be a minister

(1) Notwithstanding anything contained in sub-section (9) of Article 168, the Chief Minister may appoint any person who is not a member of the Provincial Assembly to the post of Minister on the recommendation of the Chief Minister.
(2) The minister appointed as per sub-section (1) shall obtain the membership of the Provincial Assembly within six months from the date of taking oath.
(3) If he fails to obtain membership of the Provincial Assembly within the period specified in sub-section (2), he shall not be eligible for re-appointment to the post of minister during the term of the immediately existing Provincial Assembly.
(4) Notwithstanding anything written in sub-section (1), a person who has been defeated in the election of the Provincial Assembly for the time being shall not be eligible for appointment as a minister during the tenure of that Provincial Assembly as per sub-section (1).
